Executive Guideline No. 30, 11-3-93, Revised 4-5-94; 6-7-10.
- Authority and Purpose -- Pursuant to the General Delegation of Power by the Board to the President in Section 20.020 of the Collected Rules and Regulations, the President hereby issues this Executive Guideline for the purpose of establishing a procedure to be utilized by the University in entering into any special retirement or resignation agreement with a tenured faculty member whereby the tenure rights of the tenured faculty member are voluntarily waived or relinquished by the tenured faculty member in exchange for a promise or other consideration from the University to which the tenured faculty member would not otherwise be entitled.
- Authority to Establish Special Recognition Programs -- The Chancellor of any campus within the 91Ï㽶¶ÌÊÓƵ System is hereby authorized to establish a program whereby tenured faculty members willing to voluntarily waive or relinquish their tenure rights may be selected for recognition after such waiver or relinquishment of their tenure rights by being rehired on a part-time basis as non-regular faculty members without tenure. Any such program established shall not create a right for any tenured faculty member to be selected for such recognition, but shall reserve the University's discretion to select from among those applying for such recognition only those most deserving of such recognition and for whom such recognition is in the University's best interest. Any such program established shall limit those selected rehires to term appointments, and no single term of which may exceed three (3) years in length. Any such program established may provide other benefits, but shall not provide any such benefits which are inconsistent with this or other provisions of the Collected Rules and Regulations. Prior to implementation of any such program, the terms and conditions thereof shall be in writing and shall be forwarded for review and approval by the President and the Office of the General Counsel.
- Approval for Other Special Retirement or Resignation Agreements -- If the Chancellor of any campus within the 91Ï㽶¶ÌÊÓƵ System determines that it would be in the best interest of the University to enter into any special retirement or resignation agreement beyond the scope and limitations of the program described in Section 310.075B hereof and whereby the tenure rights of a tenured faculty member are voluntarily waived or relinquished, the Chancellor may authorize preliminary negotiations with such tenured faculty member for such matter. Any preliminary negotiations shall be with the understanding that such agreement is not binding on the University until the Chancellor has recommended to the President that the tentative agreement be approved and the President has executed the agreement on behalf of the University.
